Kerry Anderson specialises in resource management and public law and focuses on local government, large infrastructure projects, iwi, and public sector work.

 

Kerry has experience across all aspects of resource management law having advised numerous local authorities, iwi clients, government, private and international clients on resource consent issues and consenting strategies, designations, plan drafting, interpretation and preparation, mediation, Council hearings, Environment Court appeals and an extensive range of enforcement matters.   She is experienced in judicial review, Council hearings, Environment Court appeals, streamlined consenting processes and an extensive range of litigation experience across all of the NZ Courts.

Kerry specialises in:

  • Large infrastructure projects and has had involvement in a number of New Zealand’s ‘roads of national significance’, prisons, landfills/recycling facilities, wind farms and wastewater treatment plants, usually on behalf of government or local government clients.
  • Consenting processes and strategies from the site selection phase through to implementation and enforcement of condition requirements.
  • Plan drafting, preparation and hearing processes, having advised local government for 20 plus years through rolling district plan reviews, full proposed regional and district plans and appeals processes, changes to Regional Policy Statements and intensification plan changes/variations.
  • The developing area of customary marine title claims under the Marine and Coastal Area legislation, having acted on one of the first few applications to proceed to a High Court hearing in 2021, which is now proceeding to the Court of Appeal in 2023. She acts for both claimants and local government clients in this space.
  • Environmental regulation impacting renewables projects as a result of a wide variety of due diligence undertaken for renewables projects, including the National Policy Statements for Highly Productive Land, Freshwater and Renewable Electricity Generation, the National Environmental Standards regarding contaminated land and freshwater, the Heritage NZ Act, the Marine and Coastal Area Act and the EEZ Act.
